1. INTRODUCTION

The Essex County Land Bank (ECLB) is seeking proposals from qualified and licensed real estate agencies to provide comprehensive real estate marketing, staging, and sales services for residential and commercial properties owned by the Land Bank throughout Essex County, New York.

The selected agency will enter into a three (3) year contract with the Essex County Land Bank to manage the disposition of Land Bank properties in a manner consistent with New York State law and the Land Bank’s mission to return vacant, abandoned, and underutilized properties to productive use.

2. SCOPE OF SERVICES

The selected real estate agency will be responsible for all aspects of marketing and selling Land Bank properties, including but not limited to:

A. Property Marketing and Listing

  • Listing all Land Bank properties on the Multiple Listing Service (MLS) and other appropriate platforms
  • Developing marketing materials, including professional photography and digital listings
  • Advertising properties to reach qualified buyers

B. Property Staging

  • Coordinating and managing staging of properties to enhance marketability (as appropriate)
  • Advising the Land Bank on cost-effective staging strategies

C. Sales and Transaction Management

  • Hosting showings and open houses
  • Managing buyer inquiries and offers
  • Assisting with contract negotiations
  • Coordinating inspections, appraisals, and closing processes

D. Compliance and Reporting

  • Ensuring all transactions comply with New York State Real Property Law, the Land Bank Act (NYS Not-for-Profit Corporation Law Article 16), and applicable local regulations
  • Providing regular status updates and sales reports to the Land Bank
  • Tracking all prospective buyers and transactions in an applicant Excel spreadsheet provided by the Land Bank, including timely updates for monitoring and reporting purposes

3. TERM OF CONTRACT

The Essex County Land Bank intends to award a contract for a term of three (3) years, with the option to renew based on performance and mutual agreement.

4. LEGAL AND LICENSING REQUIREMENTS

All proposing agencies must:

  • Be properly licensed to conduct real estate brokerage services in New York State
  • Comply with all applicable federal, state, and local laws and regulations
  • Carry appropriate professional liability insurance and general liability insurance

Proof of licensure and insurance must be included with the proposal.

5. PROPOSAL REQUIREMENTS

Proposals should include the following information:

  • Agency name, address, and primary contact information
  • Proof of New York State real estate broker license
  • Description of relevant experience, particularly with public entities, land banks, or similar organizations
  • Proposed marketing and staging strategy
  • Fee structure and commission rates
  • Description of staffing and project management approach
  • References (minimum of three preferred)

7. EVALUATION CRITERIA

Proposals will be evaluated based on:

  • Experience and qualifications
  • Proposed marketing and staging approach
  • Cost and fee structure
  • Demonstrated knowledge of the Essex County real estate market
  • Ability to comply with NYS laws and Land Bank objectives
  • Responsiveness and completeness of the proposal

8. MWBE AND SDVOB PARTICIPATION

The Essex County Land Bank encourages proposals from Minority-Owned Business Enterprises (MBE), Women-Owned Business Enterprises (WBE), and Service-Disabled Veteran-Owned Businesses (SDVOB) in accordance with New York State policies.

9. RESERVATION OF RIGHTS

The Essex County Land Bank reserves the right to:

  • Reject any or all proposals
  • Waive informalities and minor irregularities
  • Award a contract in the best interest of the organization
  • Negotiate terms with selected proposer(s)
