The Essex County Land Bank is now accepting applications to purchase the former Agway/Silas B. Moore Grist Mill lot at 74 Montcalm Street, Ticonderoga.

The property is being offered for sale now, but closing will not occur until demolition of the existing structure has been completed.

The property is being offered on the open market and applications will be considered on a first-come, first-served basis, provided the applicant agrees to the required deed restrictions and proceeds through the normal real estate transaction process.

Making an Offer

Applicants are responsible for selecting and retaining their own real estate agent and their own attorney. The Essex County Land Bank does not represent prospective purchasers.

In order to make a formal offer on the property, the prospective purchaser must have their real estate agent and/or attorney contact the Essex County Land Bank’s designated real estate agent and/or attorney.

Any formal offer must also be accompanied by proof of funds or appropriate financing/pre-qualification documentation sufficient to support the proposed purchase.

Deed Restrictions

The property will be conveyed subject to deed restrictions intended to ensure that this important downtown property does not return to blight and continues to support the revitalization of downtown Ticonderoga.

Among other requirements, the future owner will be required to:

  • Keep the property clean, safe, secure, and code-compliant;
  • Remain current on real property taxes, assessments, water and sewer charges;
  • Maintain appropriate property and liability insurance following construction of insurable improvements;
  • Prevent the property from becoming blighted, abandoned, unsafe, or a nuisance; and
  • Avoid prolonged unmanaged vacancy, junk or salvage storage, illegal dumping, or other conditions inconsistent with the downtown district.

The deed restrictions will also preserve certain rights of the Essex County Land Bank relating to future transfers of the property and will run with the land for the applicable restriction period.

A copy of the proposed deed restrictions can and will be provided directly to a prospective purchaser’s attorney for review as part of the transaction process. Purchasers are strongly encouraged to review the restrictions with their own legal counsel before entering into a binding purchase agreement.

The restrictions will also allow the Essex County Land Bank to install and maintain interpretive signage commemorating the historic Silas B. Moore Grist Mill that previously occupied the site.

Property Condition / No Site Access

The existing Agway building has been condemned and is scheduled for demolition.

For safety and liability reasons, no prospective purchaser, real estate agent, attorney, contractor, inspector, or other member of the public will be permitted to enter the building or access the condemned site for purposes of inspection prior to demolition.

Interested purchasers should base their application and initial interest on the property information made available by the Essex County Land Bank. Closing will not occur until demolition has been completed.

Submission of an application does not guarantee a sale. Any transfer remains subject to Land Bank review, agreement to the applicable deed restrictions, completion of demolition, acceptance of an offer, and the normal legal closing process.
